JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Vishnupad P.S. Case No.77 of 2016 registered under Sections 272 and 273 of the Indian Penal Code as well as Section 47(a) of the Excise Act. It is submitted by the learned counsel for the petitioner that from the FIR itself it would be evident that the owners of the incriminating illicit liquor were Jitu Singh and Uday Singh and the petitioner was simply driving the auto rickshaw in which they were sitting along with the two bags in which bottles of liquor were kept. It is further contended that the petitioner, being driver of the auto rickshaw, had no authority to check the bags of his customer sitting in it.

Patna High Court Cr.Misc. No.39813 of 2016 (2) dt.19-09-2016 2/2 Learned counsel for the State has opposed the application for grant of bail to the petitioner. Regard being had to the submissions advanced at the Bar, the petitioner, namely, Ajeet Singh, who is reported to be a man of clean antecedent and is in custody since 3rd July, 2016, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S.
