ANSARI ORAL ORDER 20-01-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accused-petitioner, namely, Rohit Sahni @ Bablu Sahni @ Gautam Sahni, in connection with Deoriya Police Station Case No. 16 of 2013, under Sections 147/148/149/307/ 399/402/ 120B of the Indian Penal Code, Sections 3, 4 and 5 of the Explosive Substance Act and Section 17 of the C.L.A. Act.
Perused the above application and materials on record.
Heard Mr. Sanjay Kumar, learned counsel for the petitioner, and Mr. S. Dayal, learned Addl. Public Prosecutor, appearing on behalf of the State. The accused petitioner was not named in the
Patna High Court Cr.Misc. No.38666 of 2014 (3) dt.20-01-2015 2/2 first information report and he has been in custody since 13.03.2014.
Considering, however, the fact that accused Saheb Sahani, who was named in the first information report, has already been allowed bail by order, dated 11.07.2014, passed in Cr. Misc. No. 16395 of 2014, this Court is of the view that in the facts and attending circumstances of the case, an order of bail in favour of the accused-petitioner, Rohit Sahni @ Bablu Sahni @ Gautam Sahni, would meet the ends of justice. Hence, it is hereby directed that the accused above-named shall be released on bail of Rs. 10,000/- with two sureties, each of the like amount, subject to the satisfaction of the learned 4th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 546 of 2014.
In terms of the above directions, this bail application shall stand disposed of.
