The petitioner seeks bail in connection with Sirdala P.S. Case No.130 of 2012 registered under Sections 498(A) and 302/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that earlier the prayer of the petitioner for grant of bail was rejected vide order dated 20.02.2014 passed in Criminal Misc.32478 of 2013 by this with a direction to the trial court to conclude the trial within one year, which would appear from Annexure-'1' to this application. It is further submitted that till 03.02.2015, not a single witness has been examined on behalf of

No.12624 of 2015 (2) dt.22-04-2015 2/2 the prosecution after framing of the charge, which would appear from the order-sheet of Sessions Trial No.175 of 2013 pending in the court of 1st Additional Sessions Judge, Nawada (Annexure-'3' to this application), which is from 10.01.2014 to 03.02.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Nawada, in connection with Sessions Trial No.175 of 2013, arising out of Sirdala P.S. Case No.130 of 2012.
