KUMAR ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in Chakai P.S. Case No.13 of 2015 instituted for the offence under Sections 15, 17, 18, 46 of the N.D.P.S.Act.
Allegation against the petitioner is of illegal cultivation of opium upon one of his plot. Nothing has been recovered from his possession and standing crop of opium was destroyed by the police. There is no seizure from the conscious possession of the petitioner.
Considering the nature of allegation and in view of the fact that nothing has been recovered from his possession or from his house and the plot upon which the opium crop was standing does not belong to him, let the petitioner, above named, be
