The petitioner seeks bail in a case instituted under Sections 353 and 307/34 of the I.P.C. and 25(1-b)a, 26, 27, 35 of the Arms Act and 20(1)/22(b) of N.D.P.S. Act.

Allegation is that two kgs of ganja has been recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.7.2017. There is no allegation of tampering of witnesses alleged against the petitioner. Two kgs of ganja is said to have been recovered, which is much below the commercial quantity.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.42584 of 2017(2) dt.20-09-2017 2/2 petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna in connection with Special (N.D.P.S.) case No.102 of 2017 arising out of Fatuha P.S. case No.290 of 2017.
