====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 03-12-2025 Heard learned Advocate appearing on behalf of the petitioners and the learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in connection with Belhar P.S. Case No. 104 of 2021, registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.

3. While the informant was going to bring cattle feed, in the meanwhile, the accused persons surrounded him and duly assaulted by means of iron rod, lathi and danda, due to which the informant sustained head injury.

4. Learned Advocate appearing on behalf of the petitioners submitted that besides the omnibus nature of allegation, there is a counter version of the present case being Belhar P.S. Case No. 107 of 2021 instituted against the informant and others. moreover, the injuries which is allegedly sustained to the informant, the same is found to be simple in nature, the petitioners are persons of fair antecedent and they undertake that they will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioners have actively participated in the crime and in a case of 2021, they have approached this Court in the year 2025.

6. Having considered the submissions advanced by learned Advocate for the respective parties and taking note of the simple nature of injury, coupled with the genesis of occurrence, besides the fair antecedent of the petitioners, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand)

Case No. 104 of 2021, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
