====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 27-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 38(i)(ii) and 41(i)(ii) of the Indian Penal Code.

Submission is that the petitioner was not there at the time of recovery of liquor from a motorcycle, rather name of the petitioner surfaced in the confessional statement of co-accused, namely, Vikrant Kumar Roy. Petitioner has got a criminal antecedent of identical nature wherein allegation of recovery of liquor was from possession of the petitioner. Considering the entire facts, let the petitioner, above named, be released on bail, after framing of the charges against the petitioner, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.52349 of 2019(2) dt.27-08-2019 2/2 each to the satisfaction of learned Court below where the case is pending in connection with S.T. (Excise) Case No. 546 of 2018 arising out of Kunauli Dagmara (O.P.) Police Station Case No. 30 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
