The petitioner seeks bail in a case instituted under Sections 273, 290/34 of the Indian Penal Code and 47(A) of the Excise Act.
Huge quantity of country made liquor are said to have been recovered from a pick-up van, which was being carried by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.08.2016. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. His name has come on the confession of co-accused, who were apprehended
Patna High Court Cr.Misc. No.44417 of 2016 (2) dt.18-10-2016 2/2 on the spot. The other co-accused have been granted bail vide Annexure-2 and 3 to the present application.
On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in connection with Barauni (Refinery) P.S. Case No. 106 of 2016. (Sudhir Singh, J.) Amit/- U T
