2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 399, 402, 414, 411 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of Arms Act.

3. As per prosecution case, on a secret information that some miscreants are about to commit crime, a raid was conducted and after seeing the police force, the miscreants fled away but two motorcycles were seized from the place of occurrence out of which in one of the motorcycles Aadhaar Card of this petitioner was recovered.

4. It is submitted that no arms and ammunition has been recovered from the conscious possession of the petitioner and he is neither driver nor owner of the motorcycles in

Patna High Court CR. MISC. No.56648 of 2023(2) dt.31-08-2023 2/2 question. Petitioner has got clean antecedent.

5. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Araria in connection with Bhargama P. S. Case No. 46 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
