The petitioners, who are trainee Constables, seek bail in anticipation of their arrest in connection with Budha Colony P.S. Case No. 435 of 2018 dated 02.11.2018 instituted for the offences under Sections 147, 148, 149, 188, 341, 323, 325, 332, 333, 337, 338, 353, 427, 449, 450, 451, 452, 461 and 120(B) of the Indian Penal Code and Sections 3/4 of Damage to

Patna High Court CR. MISC. No.55724 of 2019(4) dt.16-11-2019 2/3 Public Property Act.

The allegation against the petitioners and several other trainee Constables is that they had indulged in arson, assault and had also damaged the vehicles in the office of the superior police officers on being enraged at the death of one of the fellow trainee Constables viz. Savita Kumari Pathak in hospital. Learned counsel for the petitioners submits that there was a general feeling of dissatisfaction with respect to bad treatment being given to the fellow constable who died in hospital because of some illness. The accusation against the petitioners is general and omnibus and their implication in this case is only on the basis of their identification in the CCTV footage. One of the accused persons is reported to have been granted anticipatory bail by a bench of this Court.

Considering the gender of the petitioners and general allegations against them, they are directed to be released on bail, in the event of their arrest or surrender

Patna High Court CR. MISC. No.55724 of 2019(4) dt.16-11-2019 3/3 before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna in connection with Budha Colony P.S. Case No. 435 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
