JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is languishing in custody since 25.11.2015 in connection with Banka (Barahat) P.S. Case No. 710/2015 registered for the offence under Sections 366(A) and 494 of the IPC.
The prosecution case, in brief, is that the petitioner had abducted the minor daughter of the informant and solemnized marriage with her. On protest by the informant, attempt was made to assault him.
Earlier the bail application of the petitioner was rejected on 15.12.2016 vide Cr. Misc. No. 50311 of 2016 taking
Patna High Court Cr.Misc. No.27809 of 2017 (3) dt.30-08-2017 2/2 into account that the victim was examined under Section 164 Cr. P.C. and she alleged that she was sexually abused by the petitioner.
A report was called for from the court below regarding the stage of the case. It has been reported by the court below that the statement under Section 313 Cr. P.C. has already been recorded on 24.07.2017.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Banka (Barahat) P.S. Case No. 710/2015, pending in the court of learned C.J.M. Banka.
The court below is directed to take all necessary steps to conclude the trial within a period of two months from the date of receipt/production of copy of this order.
