2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 302 and 34 of the IPC.

3. The prosecution case in brief, is that on the alleged date and time of occurrence, informant received information that the accused persons including this petitioner killed her daughter by strangulating her neck by rope.

4. It is submitted on behalf of the petitioners that informant is not an eye witness of the occurrence and only suspicion has been raised against this petitioner because of land dispute with the family of the deceased. Petitioners are patidars of the family of the deceased. Allegation is general and omnibus. No specific overt act against this petitioner. Dead body of the deceased was found in her own maternal house.

5. Learned counsel for the State opposed the bail petition.

6. Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., East Champaran, Motihari in connection with Chiraiya P.S. Case No. 138 of 2023, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) AjayMishra/- U T
