The petitioner apprehends his arrest in Kuchaikot P.S. Case No. 365 of 2021, registered for the offences punishable under Sections 7 (i)(a)(ii) of the Essential Commodities Act. Prosecution case in brief is that petitioner was selling fertilizer at higher price without having license. It is submitted petitioner has been falsely implicated in this case. Son of the petitioner is dealer of seeds having valid license bearing 60/17-18 dated 05.08.2017 and he did not please the local authority as a result of which this false case has been lodged. Petitioner claims clean antecedent. Counsel for State opposed the prayer for bail and submitted that petitioner without having valid and proper license was selling fertilizer at higher price.

Patna High Court CR. MISC. No.66151 of 2021(2) dt.14-07-2022 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
