2. The petitioners seek bail in connection with Chiraiya P.S. Case No. 18 of 2024 instituted for the offences under Sections 341, 323, 307, 324, 379, 504, 506/34 of the Indian Penal Code.
3. Prosecution story, in short, is that the accused persons assaulted the informant and his nephew with deadly weapons over a sewerage dispute due to which they sustained injuries. It is also alleged that during the assault, a gold chain
Patna High Court CR. MISC. No.53588 of 2025(2) dt.01-08-2025 2/3 was also snatched.
4. Learned counsel for the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case due to previous land dispute between the parties. Learned counsel for the petitioners submits that general and omnibus allegation has been made against these petitioners. No specific overt act is alleged against the petitioners. It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.05.2025. Petitioner no. 1 has two criminal antecedents whereas petitioner no. 2 has one criminal antecedent. The co-accused persons have already been granted bail by this Court vide order dated 25.07.2025 passed in Cr. Misc. No. 51189 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Court
