JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but according to prosecution case itself, the alleged occurrence took place at about 5.00 p.m. on 17-03-2014 and after that, the deceased was taken to Sri Krishna Medical College & Hospital, Muzaffarpur for treatment on 18-03-2014 but he died on 18-032014 itself in course of his treatment. Furthermore, it is stated by the informant that she brought dead body of the deceased to her village and convened a Panchayati and later on, she gave written report at 1.30 p.m. on 19-03-2014. The postmortem of the deceased was done on 20-03-2014 at 11.00 a.m. In postmortem

Patna High Court Cr.Misc. No.4846 of 2015 (3) dt.24-04-2015 2/2 examination, three ante mortem injuries were found on the person of the deceased and when the chest cavity was opened, it was found that 4-6 ribs of right side of chest of the deceased were fractured.

There is omnibus allegation of assault against these petitioners.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sakra P.S. Case No. 120 of 2014 to the satisfaction of Chief Judicial Magistrate, Muzaffarpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
