Opposite party no.2 appeared through counsel whereafter it appears the matter was placed in Chambers for resolving the dispute. It appears the complainant/O.P. no.2 thereafter did not participate in the proceeding . Today also no one has appeared on her behalf.
The petitioner being husband apprehends his arrest in connection with complaint case no. 1555 of 2013, registered under Sections 498A, 504/34 and Section 3⁄4 of the Dowry Prohibition Act.
It has been stated that the husband is ready and
Patna High Court Cr.Misc. No.39299 of 2014 (5) dt.25-06-2015 2/3 willing to accept the complainant as his wife and allowed her to live with him and to afford all protection and due regard to her. Considering the aforesaid, I am inclined to extend the privilege of anticipatory bail to the petitioner. Let the petitioner, named above, in the event of his arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Siwan in connection with Complaint case no.1555 of 2013, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.
(ii) As soon as the charges are framed the petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the
Patna High Court Cr.Misc. No.39299 of 2014 (5) dt.25-06-2015 3/3 petitioner and secure his arrest in accordance with law.
