The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 353, 188 and 409 of the Indian Penal Code.

Prosecution case is that folders of Shikha Mitra and first phase of Panchayat teachers were not made available to vigilance and as such on the direction of Principal Secretary Education Department as also the order of DPO, Nawada, the FIR has been registered against the petitioner and other accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner was not present at the relevant

Patna High Court CR. MISC. No.66556 of 2021(2) dt.18-07-2022 2/2 time of employment of Shikhsa Mitra and First phase teacher employment at Channaun Panchayat. He further submits that when the petitioner joined there as Panchayat Secretary at Channaun Panchyat, he was not handed any documents with regard to same and hence, he is not liable for any charges levelled in the FIR. Petitioner has got clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Nawada in connection with Roh P.S. Case No. 08 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
