====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.
Petitioner is the son of the erstwhile Night Guard of Ramadhin College, Sheikhpura.
Learned counsel appearing on behalf of petitioner submits that the father of the petitioner died on 09.11.2010. He further submits that the salary admissible to the father of the petitioner was not paid and as such he has filed the present writ application for a direction to the respondents to make payment
Patna High Court CWJC No.17507 of 2019(2) dt.28-08-2019 2/2 of arrears of salary of the father of the petitioner. If the father of the petitioner has worked and any amount is payable to the father of the petitioner than after his death the respondents are under obligation to ensure payment of salary of the arrears of the employee who died during service without getting salary to the legal heirs of the employee.
Necessary decision in this regard must be taken by the respondents within a maximum period of three months from the date of receipt/production of a copy of this order and whatever is admitted by the respondents, the admitted amount would be paid to the legal heirs of the erstwhile employee. With the aforesaid, the writ application stands disposed of.
