27-03-2015 Heard learned counsel for petitioners and Smt. Anusaiya Jaiswal, learned Addl. Public Prosecutor. Two petitioners, apprehending their arrest in Dumra P.S. Case No. 212 of 2014 registered for the offence under Sections 341, 323, 452, 380, 307, 354, 504, 506/34 of the Indian Penal Code, have prayed for grant of anticipatory bail. It was submitted by learned counsel for petitioners that petitioners are bataidar of complainant and due to family dispute, a complaint was filed in the court of Chief Judicial Magistrate, Sitamarhi, which was referred to police and thereafter, an F.I.R. under Section 156(3) of the Code of Criminal Procedure has been instituted.
In view of the facts and circumstances, particularly
Patna High Court Cr.Misc. No.38146 of 2014 (2) dt.27-03-2015 2/2 the fact that for alleged offence instead of lodging F.I.R. initially the compliant was filed, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. In the event of arrest or surrender within a period of eight weeks from today, both the petitioners, namely; Randhir Mandal and Uday Mandal shall be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 212 of 2014 under conditions as contemplated under Section 438(2) of the Cr.P.C.
