The petitioner is languishing in custody since 19.01.2015 in a case registered for the offences punishable under Section 7 of Essential Commodities Act.

One truck loaded with government supply rice collided with a jeep leading to death of two persons including Motor Vehicle Inspector and the driver for which Jalalgarh P.S. Case No. 248 of 2014 was registered under Sections 353, 307, 302 and 120B/34 of the Indian Penal Code. Petitioner was also named accused, but he has been granted bail vide Cr. Misc. No. 8273 of 2015.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.14085 of 2015 (02) dt.27-04-2015 2/2 petitioner that the petitioner is in no way connected with the seized rice. He is simply owner of the truck being a public carrier and the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Purnea in connection with Jalalgarh P.S. Case No. 249 of 2014.
