2. The required report has been received from the court of learned Railway Judicial Magistrate, Civil Court, Ara (Bhojpur), which shows that the charges have been framed against six accused persons after splitting the record and, the record is running at evidence stage. It has also been mentioned that the informant has filed an application before the court below to record his evidence through video conferencing mode and presently, the record is fixed for hearing on application and evidence.
3. The report does not reveal as to what has happened to the application of the informant but the learned counsel for
Patna High Court CR. MISC. No.60530 of 2023(4) dt.01-12-2023 2/2 the petitioner has submitted that the said application has fbeen rejected by the court below and the informant did not produce himself for recording of his evidence and due to apathy of the informant, the case is pending at the evidence stage.
4. The learned trial court is directed to expedite the trial. It is expected that the trial shall be concluded within a period of six months failing which, the petitioner shall be entitled to renew his prayer for bail.
5. With the aforesaid observation, this application stands disposed of.
