2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 276 of 2023 registered for the offences under Section 394 of the Indian Penal Code.

3. The petitioner is named in the F.I.R. and is in custody since 23.05.2024.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner was granted anticipatory bail through Cr. Misc. No. 35099 of 2024 vide order dated 12.07.2024 but infact he was arrested in the present case on 23.05.2024 and this fact was not communicated to him

Patna High Court CR. MISC. No.65229 of 2024(2) dt.20-09-2024 2/2 by deponent (pairivikar) of this case, therefore he was not in a position to convey on 12.07.2024 when anticipatory bail of petitioner was taken on board.

5. Heard learned APP appearing on behalf of the State.

In view of the facts and circumstances as mentioned above as petitioner was granted anticipatory bail by this court vide aforesaid order, where now petitioner is in custody since 23.05.2024, accordingly, petitioner, above named, is directed to be released on bail in connection with Muffasil P.S. Case No. 276 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of the BNSS.
