JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in Bidupur P.S. Case No. 382 of 2022, registered for the offence punishable under Section 30(a)(c) of the Bihar Prohibition and Excise Act. 1200 litres of country liquor along with manufacturing materials has been recovered from the place of recovery. Local chowkidar disclosed the name of this petitioner. It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place.

Counsel for the State vehemently opposed the bail application and submitted that petitioner has got one criminal antecedent of similar nature.

Patna High Court CR. MISC. No.58185 of 2022(3) dt.09-12-2022 2/2 Considering the criminal antecedent, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
