JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioners seek bail in connection with Jamalpur P.S. Case No. 53 of 2014 registered for the offences punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act. According to the prosecution case, one country made loaded pistol and five live cartridges are alleged to have been recovered from the possession of petitioner no.1 Deepak Singh whereas thirty five live cartridges are alleged to have been recovered from the possession of petitioner no.2 Ravinath Singh @ Ravi Ranjan Singh.

The prayer for bail of the petitioners were earlier

Patna High Court Cr.Misc. No.21680 of 2015 (2) dt.13-05-2015 2/2 rejected by this Court vide order dated 20th October, 2014 passed in Cr. Misc. No. 39542 of 2014 with an observation that if the trial of the petitioner is not concluded within six months the petitioners would be at liberty to renew their prayer for bail. It has been contended that the petitioners are in custody since 7th May, 2014 but till date not even a single witness has been examined on behalf of the prosecution. Regard being had to the facts and circumstances of the case, both the petitioners, namely, Deepak Singh and Ravinath Singh @ Ravi Ranjan Singh are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Jamalpur P.S. Case No. 53 of 2014.
