The petitioner apprehends his arrest in a case registered for the offence under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, total 975 bottles of Nepali Saufi wine of 300 ml. Each i.e. 292 litres 500 ml. was recovered from the house of co-accused Md. Ajhar Ali. When police raided the house of co-accused, one person fled away on seeing the police. The local Chowkidar identified him as a petitioner. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. There was no recovery of incriminating materials from the conscious posses-

Learned A.P.P. for the State has opposed the bail petition. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge (Excise Act), Sitamarhi in connection with Bairgania P.S. Case No. 56/2021, subject to condition as laid down under section 438(2) of the code of criminal procedure.
