The petitioners apprehend their arrest in connection with Sarairanjan P.S. Case No. 44 of 2018 registered under Sections 323, 363, 366(A) and 504 of the Indian Penal Code. The accusation is that in the evening of 14.04.2018, sister of the informant had gone to attend the call of nature but she did not return. In course search, mother of the informant came to know that his sister was kidnapped by the son of both petitioners. When the family members of informant went at the house of the petitioners and asked about the aforesaid facts then all accused persons started to abuse and assault to them. Learned counsel for the petitioner submits that it
Patna High Court Cr.Misc. No.50197 of 2018(2) dt.20-09-2018 2/2 would appear from the F.I.R. that the specific allegation is against Rajeev Kumar Giri, son of both petitioners, to kidnap the sister of the informant due to that reasons both petitioners have falsely been implicated in this case.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- VI, Samastipur, in connection with Sarairanjan P.S. Case No. 44 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
