JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Petitioner is languishing in custody since 13.11.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code. On recovery of the dead body with fire arm injury near a river, on the fardbeyan of the Chaukidar, First Information Report was registered against unknown. The name of the petitioner transpired during investigation on the confessional statement of co-accused Gorelal Tanti. It is submitted by learned counsel for the petitioner that except confession of the co-accused, no material has been collected during investigation against the petitioner and the investigation has already concluded.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.14095 of 2015 (2) dt.28-04-2015 2/2 amount each to the satisfaction of learned Additional District Judge-III, Jamui in connection with Sessions Trial No. 20 of 2015, arising out of Luxamipur P.S. Case No. 69 of 2014. Since the petitioner has serious criminal antecedent, let learned Court below positively cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
