JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2023 The learned counsel for the petitioner has submitted that for the purposes of removal of the encroachment in question, the Circle Officer, Basantpur, Siwan, had initiated encroachment proceedings vide Encroachment Case No. 22 of 2016-17 and thereafter, order has also been passed by him on 30.12.2016 for removal of the encroachment in question, however, till date the encroachment in question has not been removed.
In view of the aforesaid, this Court deems it fit and proper to grant liberty to the petitioner to approach the District
Patna High Court CWJC No.14452 of 2022(2) dt.09-05-2023 2/20222 Magistrate, Siwan and in case appropriate representation is filed within a period of two weeks from today with regard to his aforesaid grievances, the District Magistrate, Siwan, shall take appropriate action, in accordance with law and do the needful with regard to resolving the issue in question and pass a reasoned and a speaking order thereon, within a period of six weeks, thereafter.
The writ petition stands disposed off on the aforesaid terms.
