JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-12-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Md. Fahimuddin, learned A.P.P. for the State as well as Mr. Ajay Kumar Jain, learned counsel for the informant. This is the second attempt of the petitioner to obtain bail in connection with Turkauliya P.S. Case No.648 of 2019 registered for the offences punishable under Sections 341, 324, 326, 307, 302, 120B and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 21.09.2019.
Learned counsel for the informant submits that this
Patna High Court CR. MISC. No.66077 of 2021(2) dt.01-12-2021 2/2 Court has rejected the prayer for bail of the petitioner earlier vide order dated 13.04.2021 in Cr.Misc.No.2170 of 2021 considering the gravity of the offence alleged and that the deceased had suffered multiple fire-arm injuries which were corroborated by the postmortem report as also that the petitioner has got criminal antecedents.
Learned counsel for the informant has further submitted that the petitioner if released is not likely to allow the trial to be concluded because the witnesses are being threatened. Having regard to the materials noticed by this Court in its order dated 13.04.2021 and the submissions made at the bar in the present case pointing out the potential threat to the witnesses of this case, this Court is not inclined to release the petitioner on bail.
