JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2017 This application has been filed for modification of order dated 18.5.2017 passed in Cr.Appeal (SJ) No.1214 of 2017, by which the appeal was allowed and the appellants were directed to surrender within a period of six weeks and on their so surrendering they were directed to be released on bail. Now the present application has been filed for modification of the said order on the ground that they could not surrender within the time specified because of communication gap.

Having heard both sides and in the facts and circumstances, I am not inclined to interfere with the earlier order. However, let appellants surrender within a reasonable period and make prayer for regular bail, which shall be considered in view of the fact that petitioners were earlier granted anticipatory bail and

Patna High Court Cr.Misc. No.43076 of 2017 (2) dt.06-09-2017 2/2 could not appear within the time prescribed.

With the above observation, this application is disposed of.
