====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 16-11-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are apprehending their arrest in connection with Complaint Case No. 95C of 1999 for the offence registered under Sections 498(A), 494 of the Indian Penal Code.
The petitioners are husband and brothers-in-law in a case registered under Section 498(A) and 494 of I.P.C. Learned counsel for the petitioners submits that the entire allegation against the petitioners is false and mischievous
Patna High Court CR. MISC. No.55192 of 2019(4) dt.16-11-2019 2/2 and actually she has herself left the petitioner. It is further submitted that there is no demand for dowry as is evident from the complaint case. Learned counsel for the petitioners submits that the petitioners are ready to reconcile the issue with the complainant.
Notices were issued to the Opposite Party No. 2 but the same have been returned stating that she is not available at the address in the complaint petition.
In view of the aforementioned facts and circumstances, let the petitioners nos. 2 and 3, above named, in the event of their arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur, in connection with Complaint Case No. 95C of 1999, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
