1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, namely, Sohan Ram, who was arrested during pendency of the instant anticipatory bail application.

3. Permission is accorded.

4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1, namely, Sohan Ram.

5. The petitioner no.2 seeks bail in anticipation of his arrest in a case registered for the offences punishable under

Patna High Court CR. MISC. No.54816 of 2025(2) dt.25-08-2025 2/3 Sections 126(2), 115(2), 118(1), 109, 352, 303(2), 3(5) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a young boy aged about 23 years and the informant alleges that Sohan Ram along with this petitioner came and started abusing and thereafter, Sohan Ram assaulted the informant by an iron rod causing injury on head, thereafter petitioner assaulted the informant by knife causing injury on backside of his head.

7. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case being son of Sohan Ram. It is also submitted that no doubt, petitioner is alleged to have assaulted the informant by knife causing injury on backside of the head, but then, from perusal of the injury report annexed as Annexure- P/2 to the anticipatory bail application, it would manifest that the same records that injures are simple in nature caused by hard and blunt substance. It is thus submitted that had the petitioner assaulted the informant by knife causing injury on head, in that event, the injury would have been opined to be incised. It is also submitted that petitioner is a young boy and is a student and in the event, if he is sent to judicial custody, his entire career would get

8. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Bettiah, West Champaran/ Successor Court in connection with Shikarpur P. S. Case No.494 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C. with condition that one of the bailors of the petitioner shall be his brother Guddu Kumar.
