====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 21-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is languishing in custody since 01.05.2019 in a case for the offence registered under Sections 363, 365, 302 and 201/34 of the IPC.
The prosecution story, in brief, is that on 17.04.2019 at about 4.00 P.M. the father of the informant had gone to market for bringing vegetable but when he delayed in returning then he started searching to him but no any clue was found up till now of his presence. Further he has stated the features of his father who is aged about 50 years colour-Gora, height 5' 6" and bearing Lungi of white colour and half shirt of Safron colour and also bearing slipper in feet.
Patna High Court CR. MISC. No.51541 of 2019(2) dt.21-08-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the basis of confessional statement of co-accused. Except for confessional statement of co-accused, there is no other substantive evidence to suggest the implication of the petitioner in the present case.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Bhojpur at Ara, in connection with Sikrahta P.S. Case No. 50 of 2019.
