On getting confidential information regarding assemblage of miscreants, a raid was conducted during the course thereof, three parsons were apprehended, while three managed to escape. On search, apart from recovery of other items, from the possession of the petitioner one country made loaded pistol along with 13 cartridges, from the possession Chitu @ Hemchandra, one country made loaded pistol, four live cartridges and from possession of Chiku, a pistol loaded with six cartridges, Blolero Jeep have been seized. They also named their associates. It is apparent from the order of the learned lower court that Chitu @ Hemchandra, on account of being juvenile, has already been granted bail, while Chiku has been granted bail vide Cr.Misc.No.10527 of 2015.

Accordingly, the petitioner Birju Mahto @ Tikku Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.20794 of 2015 (2) dt.03-07-2015 2/2 each to the satisfaction of Additional District and Sessions Judge, IV, Samastipur in connection with Sessions Trial No.27 of 2015 arising out of Tajpur P.S.Case No.351 of 2014. Taking into account the criminal antecedent, as has been incorporated in para-3 of the petition, the petitioner is directed to appear before local police station, i.e. Tajpur Police Station, at every fortnight and will seek attendance certificate therefrom which will be produced by him before the learned Sessions Judge. In case of failure on the part of the petitioner to comply with the direction, the privilege of bail will automatically stand cancelled. For proper compliance of the order, learned lower court will send a copy of the order before the Officer-in-Charge, Tajpur Police Station.
