The petitioner seeks bail in a case registered under Sections 341, 323, 354B, 366 of the Indian Penal Code. Prosecution case, in short, is that on 14.04.2019 at 7 p.m. informant's daughter, namely, Shakuntala Kuamri went with her mother, after coming of her mother, his daughter did not come back and the informant started searching her. On 15.04.2019, the informant caught his daughter with Md. Sahnawaj. When informant asked his daugher, his daughter stated that Md. Sahnawaj was taking with her after seducing and she was molested by him.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.04.2019 and has got no

Patna High Court CR. MISC. No.51724 of 2019(2) dt.20-08-2019 2/2 criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has been recovered. Her statement under Section 164 of Cr.P.C. has been recorded. There is no allegation of sexual assault alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
