The petitioner seeks bail in connection with Kuchaikot P.S. Case No. 147 of 2016 registered for the offences punishable under Sections 370, 371, 372, 373, 376 and 506 of the Indian Penal Code and under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic Act and under Sections 3, 5 and 9 of POCSO Act. It has been submitted on behalf of the petitioner that there is no allegation against the petitioner. Petitioner was present at the place of occurrence and the co-accused namely, Dhananjay Singh has been granted bail vide order, dated 3.10.2016, passed in Cri. Misc. No. 41161 of 2016 and Prithivi Nath Singh has been granted bail vide order, dated 21.10.2016 passed in Cri. Misc. No.

Patna High Court Cr.Misc. No.49939 of 2016 (2) dt.14-12-2016 2/2 41924 of 2016, the petitioner is incarcerating in jail custody since 22.07.2016, having no criminal antecedent.

opposes the prayer of bail application.

Having heard both sides, in view of the fact that save and except petitioner was present at the place of occurrence nothing has come on record and co-accused has been granted bail by this court, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Gopalganj in Kuchaikot P.S. Case No. 147 of 2016. (Vinod Kumar Sinha, J) siddharth/- U T
