2. The petitioner seeks regular bail in connection with Bhagwan Bazar P.S. Case No. 320 of 2021, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution, 125 litres of country made liquor kept in three jute bags has been recovered from the orchard and the petitioner is in custody since 27.06.2023.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional District & Sessions Judge-cum-1st Exclusive Special Judge, Excise, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 320 of 2021.

8. This is also subject to the condition that the petitioner shall mark his presence in Bhagwan Bazar Police Station, District- Saran, Chapra on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
