1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(2), 109, 352 and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 1 is a woman and the informant alleges that accused persons including the petitioners came and started abusing. On objection, Chandan Kumar and Rahul Kumar assaulted the informant by Gandasa causing injury on fingers of both the hands. Thereafter, Baiju Paswan assaulted Raj Kumar Nirala by lathi causing injury on his head. Further, Vikash Kumar
Patna High Court CR. MISC. No.58929 of 2025(2) dt.10-09-2025 2/3 assaulted Chandan Paswan indiscriminately by lathi causing injury on head while Ajeet Paswan assaulted Chandan Paswan causing injury on his back. It is further alleged that in the occurrence, friend of Chandan was also involved.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioners. It is next submitted that Masaurhi P.S. Case No. 229 of 2025 has been instituted by Vikash Kumar against the informant and her side. It is also submitted that Chandan Kumar, from the side of the petitioners, sustained ten injuries out of which four injuries are on vital part of the body. It is submitted that specific allegation of assault is against Baiju Paswan, Vikash Kumar and Ajeet Paswan. It is further submitted that petitioner no. 1 is aged about 45 years and petitioner no. 2 is aged about 50 years and they have remained persons with clean antecedent all throughout and are not the criminals. It is next submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.
5. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.58929 of 2025(2) dt.10-09-2025 3/3 anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Masaurhi P.S. Case No. 230 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
