The petitioner seeks bail in POCSO case No. 22 of 2016 arising out of Barauni (Chakiya) P.S. case No. 170 of 2016 under Section 354A of the Indian Penal Code and under Section 8 of the POCSO Act.

The informant alleged that his minor daughter was playing along with children but she became traceless. During the course of search, he found his daughter in the hut of Rajiv Singh. She was naked and crying. The petitioner was catching her and he was also kissing her.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. The

Patna High Court Cr.Misc. No.39161 of 2016 (3) dt.22-11-2016 2/2 petitioner is in jail since 25.05.2016. The victim has also reiterated the same facts that petitioner was kissing her after untying her clothes.

Considering the nature of allegation made against the petitioner and the fact that petitioner is in jail for last six months and he has got no criminal antecedent, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO, Begusarai in POCSO case No. 22 of 2016, arising out of Barauni (Chakiya) P.S. case No. 170 of 2016.
