1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Koilwar P.S. Case No. 507 of 2022 dated 07.08.2022 registered for the offence(s) punishable under Section(s) 341, 323, 324, 325, 379, 504, 506, 354/34 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has fair and clean antecedent and co-accused persons have been granted anticipatory bail by a co-ordinate bench of this court vide order passed in Cri. Misc. No. 69065 of 2022 and the injuries of the injured persons detailed in the FIR have been opined to be simple in nature by the Doctor concerned and a land dispute running in between both the parties is stated to be the genesis of

Patna High Court CR. MISC. No.57877 of 2023(2) dt.20-09-2023 2/2 the occurrence. Further submission is that the instant matter is a counterblast of Complaint Case no. 1377 of 2022 filed by the petitioner and there is no serious allegation against the petitioner.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions as well as taking into account the nature of allegation appearing against the petitioner from the FIR and also the privilege of anticipatory bail to the co-accused persons having been granted by a coordinate bench of this court, this court is inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Koilwar P.S. Case No. 507 of 2022 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
