JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 01.06.2019 in a case registered under sections 392 of the Indian Penal Code. One Rajesh Kumar Sah son of Kamleshwar Sah was made accused with allegation of loot. In course of investigation, petitioner was arrested by the police and investigating officer claimed that name of petitioner is Ranjeet Kumar @ Rajesh Kumar Sah but investigating officer also admitted at Para-34 of the case diary that the name of brother of petitioner is also Rajesh Kumar Sah.

In Para-6 of the petition, the petitioner has specifically pleaded that petitioner does not have alias name as Rajesh

Patna High Court CR. MISC. No.55279 of 2019(3) dt.27-11-2019 2/2 Kumar and the name of his elder brother is Rajesh Kumar Sah7 but police wrongly implicated the petitioner in the present case. Para-3 of the petition goes to show that petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Udakishunagnj in connection with Udakishunganj P.S.Case No. 176 of 2019.
