====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 210 of 2016 dated 20.10.2016 for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code and 27 of the Arms Act.

The allegation is with regard to the petitioner herein opening fire by a country made pistol upon the brother of the informant, resulting in his death on the spot. The petitioner, being the main assailant, is not entitled for grant of regular bail in this case, since the offence has resulted in death of the brother of the informant.

The learned counsel for the petitioner fairly submits that the trial may be expedited.

No.37952 of 2017 (2) dt.10-08-2017 2/2 In aforesaid view of the matter, though the prayer for regular bail is rejected, the learned trial court is directed to conclude the trial of the petitioner in connection with Sessions Trial No. 295 of 2017 arising out of Gopalpur P.S. Case No. 210 of 2016 pending before the learned Ist Additional District & Sessions Judge, Naugachia, District Bhagalpur, expeditiously, preferably within a period of one year.
