JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
After recovery of one unknown dead body it came to light that deceased was son in law of co-accused, Barfi Devi, who confessed her guilt before the police disclosing this fact that she along with petitioner and others committed the murder of the deceased as deceased was in habit of torturing her daughter. Submission on behalf of the petitioner is that coaccused, Barfi Devi has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 10.08.2016
Patna High Court Cr.Misc. No.39119 of 2016 (2) dt.26-09-2016 2/2 passed in Cr. Misc. No. 25092 of 2016 and the investigation against the petitioner has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jamui in connection with Sono (Charkapathar) P.S.
