2 The petitioner apprehends his arrest in connection with Sasaram Nagar PS Case No 165 of 2013 dated 20.02.2013 instituted under Sections 465, 467, 468, 471, 406, 419, 420 of Indian Penal Code.
3 As per the prosecution case, the petitioner had taken a loan of Rs 1,05,000/- from the Bank of Baroda and the Bank found that LIC policy, deposited by petitioner and other coaccused persons were fake. 4 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He has already paid Rs 1,29,600/- to the informant-Bank. Petitioner
Patna High Court CR. MISC. No.58403 of 2023(2) dt.20-09-2023 2/2 has no criminal antecedent. It is further submitted that similarly situated co-accused Manoj Kumar Dwivedi has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 14.07.2016 passed in Cr Misc No 13987 of 2016. 5 Learned APP opposes the prayer for anticipatory bail.
6 Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas in connection with Sasaram Town PS Case No 165 of 2013 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
