The petitioners seek bail in a case registered for the offences punishable under sections 307 and other allied sections of the Indian Penal Code.
Informant Dinesh Yadav has named 10 persons including the petitioners Ram Chandra Yadav and Sintu Kumar and alleged that they made indiscriminate firing. The informant in the later part of his statement has made specific allegation against accused persons that Shankar Yadav fired which hit on the arm of the informant. Arvind Yadav fired which hit near the eye of Mina Devi. When Anandi Yadav came on hearing the sound of firing, accused Vijay Yadav fired which hit on the neck, arm pit and
Patna High Court Cr.Misc. No.21465 of 2015 (3) dt.04-09-2015 forehead of Anandi Yadav. Lakhan Yadav fired which hit Kuldip Yadav and Arun Yadav. When Raja Gopal and Vicky Kumar came, then petitioner no. 1 Ram Chandra Yadav fired which hit Raja Gopal. There is no allegation of firing against petitioner no. 2 Santu Kumar. Raja Gopal got one lacerated wound and another is abrasion. The injuries are opined to be simple in nature. The I.O. did not get any injury report of Vicky Kumar. Considering the facts aforesaid and that the firing made by petitioner no. 1 Ram Chandra Yadav caused only simple injury to Raja Gopal and Vicky Kumar and there is no allegation of firing against petitioner no. 2 Sintu Kumar, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 74 of 2015.
