JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard the learned counsel for the petitioners and the learned APP for the State, through Video Conferencing. The petitioners seek bail in connection with Sikti P.S. Case No. 177 of 2021, instituted for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioners submits that the petitioners are in custody since 11.09.2021, are persons with clean antecedent and charge-sheet has been submitted and allegation is of recovery of 206.400 litres of liquor from the petitioner and one other accused.

The learned counsel submits that the petitioners were

Patna High Court CR. MISC. No.66167 of 2021(2) dt.11-02-2022 2/2 passer by where search was being made and he came to be implicated by the police, who has falsely alleged that liquor belongs to him.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact the petitioners are in custody since 11.09.2021, are persons with clean antecedent and chargesheet has been submitted, the petitioners, above-named, are directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge, Excise Act, Araria, in connection with Sikti P.S. Case No. 177 of 2021. The application stands allowed.
