JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 504, 506, 420, 467, 468, 471, 201 of the Indian Penal Code.

Petitioner is not named in the first information report and it appears from perusal of the impugned order that name of petitioner surfaced in this case in course of investigation. However, the learned Additional Sessions Judge has not mentioned in the impugned order as to on which basis petitioner has been roped in this case.

Submission on behalf of the petitioner is that as a matter of fact, petitioner solemnized his love marriage with one

No doubt, petitioner carries criminal antecedent of two cases but considering the facts and circumstances of the case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Buxar in connection with Buxar Nagar P.S. Case No. 380 of 2015.
