The petitioner seeks bail in a case registered under Section 302 and other sections of the Indian Penal Code. Rajendra Mukhiya, the brother of the deceased Mohan Mukhiya, alleged that his brother had gone to bring his wife but his father-in-law and brothers-in-law poisoned him to death. It is submitted that the informant is not an eye-witness of the occurrence. Petitioner is the brother-in-law of the deceased. Sukhram Mukhiya, father-in-law of the deceased, and Rudal Mukhiya, brother-in-law of the deceased, have already been enlarged on bail vide orders passed in Cr. Misc. No. 40992/2014 and Cr. Misc. No. 11962/2015. The case of the petitioner stands on the same footing.
Patna High Court Cr.Misc. No.22021 of 2015 (2) dt.07-07-2015 2/2 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in Jogapatti P.S. Case No. 314 of 2013.
