JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.
Allegation is while informant and his cousin were returning to their house, 3 to 4 miscreants assaulted them and looted cash of Rs.30,000/- and their belongings. It has been submitted on behalf of petitioner that he is in custody since 21.8.2016. Petitioner has got no criminal antecedent. No allegation of tampering of evidence is alleged against petitioner. Petitioner is said to have used the looted mobile for a short period. He had no knowledge that the said mobile is a looted article. He has not been put on T.I.P. to ascertain his involvement in the present case. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
