JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 0404-2015 on the accusation that he did not supply rice to the Bihar State Food & Civil Supplies Corporation Ltd. and accordingly, defalcated huge government money. The contention on behalf of petitioner is that an agreement was executed between the parties and according to terms of the agreement, the Bihar State Food & Civil Supplies Corporation Ltd. had right to lodge certificate case under the provision of Bihar & Orissa Public Demand Recovery Act, 1914.

Considering the aforesaid facts and
